QUESTION: I am developing a commercial project. I don't settle on the land until next year. How far in advance of the closing should I order title?
ANSWER: You should order NOW because: 1) there may be an easement or restriction which will prevent or impair your development plan, 2) there may be an open issue in title, such as a paid off but not satisfied mortgage, that takes months to clear, 3) you may not be dealing with the real owner. There are numerous other reasons. We like to have ALL title work done months before closing so that we do not delay a closing.
QUESTION: My lender wants a "creditors rights" endorsement. How much is it?
ANSWER: This endorsement is not available from any know underwriter. It is not really title insurance and all the issues are usually only in the imagination of lenders. We can have a direct conversation with your lender to address this issue to their satisfaction.
